Go Visitor Card or Explorer Pass Holder Go Review Contest “Official Rules”
1. ELIGIBILITY The Go Visitor Card or Explorer Pass Go Review Contest (the “Go Review Contest”) is open and available to individuals who share their travel experience and writings visiting a Go Visitor Card or Explorer Pass destination on any website listed above. The Go Review Contest is offered and open to legal residents of the United States and its territories and to legal residents of Canada, who are at least 18 years old.
2. CONTEST PERIOD The contest CONCLUDES ON November 1, 2007 at 23:59 (EST), but can be modified by Smart Destinations, Inc. All modifications will be posted on the Smart Destinations website at the following location: http://www.smartdestinations.com/write
3. ENTRY In order to enter the Go Review Contest, you go to one of the independent review sites on our list, and write a review about your personal Go Card or Explorer Pass experience. Once the review is posted, you must fill out the entry form and include the link where your review is posted. You, yourself, do not have to be the purchaser of a Go Visitor Card or Explorer Pass(s) used, in order to enter the contest. In order to enter to win you must: Successfully send us your experience, story and Go Review and URL where your review is otherwise listed, which must include your Email Address and (if available) a Go Visitor Card or Explorer Pass Number (on the back of the card). You can submit up to 5 reviews about your experience, but each entry must be a unique (you can not post the same review to various sites). Multiple entries are allowed however, there may be only 1 (one) winner selected per household.
4. USE OF ENTRIES All entrants will consent to their name, Go Review submission, along with the town/city and state/province where they reside; to be used on Smart Destinations web sites or any future Smart Destinations marketing or publicity materials or publications. All submissions become the property of Smart Destinations.
5. DRAWING One (1) winner will be selected based on the best Go Review (as chosen by our judges) submitted after July 1st, 2007 from eligible entries received during the Contest Period. Each winner will receive written notification by email from Smart Destinations confirming their contact information and each winner must reply to the email and confirm all of their contact information within 5 (Five) business days of receiving the notification email. Smart Destinations reserves the right to cancel the winning selection after the fifth (5th) business day passes, in which case the prize will be forfeited and an alternate winner will be selected. Any alternate winner will be selected randomly through a subsequent drawing.
6. PRIZE/ODDS One (1) Total Prize of 1 Amazon.com gift-card valued at $300. One prize can be awarded per entry. Prize is valued up to $300 US Dollars. Prizes cannot be redeemed for cash. Odds of winning in this random drawing depend on the number of eligible entries received for the Contest period. No assignment, transfer or substitution of prize is permitted. Prize winners are advised that Tax implications may arise from their prize winnings and they should seek independent financial advice prior to the acceptance of the prize.
7. PRIVACY POLICY We will only collect personal information that is provided to us to complete the entry to the Go Review Contest. This includes any information that can be used to identify you individually, such as name, e-mail address and Go Card or Explorer Pass registration number. All qualified, selected winners must reply to the Smart Destinations winner notification email with the following information to verify the winner: Full name, Mailing address and Phone number. This specific information will only be collected for each winner of the Go Review Contest. We will never sell or rent any personal information to any third party for marketing, commercial, or any other purpose. The information will be used for the distribution of prizes and may be used by Smart Destinations, Inc. for future promotional, marketing and publicity purposes. You must provide this information in order to participate in the competition.
8. GENERAL CONDITIONS & LIMITATIONS By accepting a prize, each winner releases and agrees to hold harmless Smart Destinations, Inc. from any and all liability for any injuries, loss or damage of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a prize, participation in any sweepstakes related activity, or participation in this Go Review Contest. As a condition to accepting a prize, winners will consent to their name, pictures along with the town/city and state/province where they reside; being added to the list of winners posted online or through any future Smart Destinations marketing or publicity materials. Any use of robotic, automatic, macro, programmed or like entry methods will void all such entries by such methods and persons using any such methods will be disqualified. If for any reason this Go Review Contest is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of Smart Destinations, Inc., corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Go Review Contest, Smart Destinations, Inc. reserves the right to cancel, terminate, modify or suspend the Go Review Contest and conduct a random drawing to award the Prizes using all eligible non-suspect entries received as of the date on which any such action is taken or as deemed fair and appropriate by Smart Destinations, Inc. subject to any direction given under the Lottery and Gaming Regulation 1993 (SA), and state permit regulation. If the Go Review Contest is terminated due to tampering or technical difficulties prior to its expiration date, notice will be posted at http://www.smartdestinations.com/write. Smart Destinations, Inc. assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Smart Destinations, Inc. is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Smart Destinations, Inc. on account of technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof. Employees and their immediate families of Smart Destinations, Inc. are ineligible.
9. DISPUTES Except where prohibited, as a condition of participating the Go Review Contest, participant agrees that any and all disputes which cannot be resolved between the parties, claims and causes of action arising out of or connected with this Go Review Contest, or any prizes awarded, or the determination of winners shall be resolved individually, without resort to any form of class action exclusively by arbitration pursuant to the commercial arbitration rules of the American Arbitration Association, then effective. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with entering this Go Review Contest), and participant further waives all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Smart Destinations, Inc. in connection with the Go Review Contest, shall be governed by, and construed in accordance with, the laws of the State of Massachusetts without giving effect to the conflict of laws rules thereof, and all proceedings shall take place in that State in the City of Boston, State of Massachusetts.
10. WINNERS LIST The name, writing(s), hometown, and testimony of the winners may be posted on any of the Smart Destinations owned and operated websites.
